Petra Herzfeld Olsson elaborates in Chapter 24 on the role given to and taken by Social Partners within the EU equality law context as it applies to the labour market. This is done through an analysis of the equal treatment legal framework, the outcome of the EU Social Dialogue and the case law of the CJEU. The analyses demonstrates that the Social Partners are identified as key players in safeguarding the intentions behind the equal treatment directives adopted on the basis of Articles 19 and 157 TFEU, and that Social Dialogue therefore should be promoted. This does however not mean that the Social Partners can dispose of their members’ rights to equal treatment in any other way than provided for in the equal treatment acquis. The fundamental right to collective bargaining is subordinated to the fundamental right to equal treatment in the EU law context.
