Abstract [en]

The aim of this study is to examine how girls sexual behavior is described in administrative law verdicts in accordance to the Care of Young Persons act, 3 § and the necessary condition ” other social degrading behavior” in 2018. The questions is how the social welfare committee and the administrative law describe girls sexual behavior in the selected verdicts and how they motivate the compulsory institutional care for these girls when they mention their sexual behavior. This is analyzed through a qualitative thematic analysis, and by a gender- and sexual theoretical perspective, of 41 verdicts. The conclusion is that the sexual behavior appears as a sexual risk behavior that is mentioned explicit in 10 of 41 verdicts. It’s not mentioned by the authorities what the sexual risk behavior is definiated as. The analysis therefore seeks to understand what a sexual risk behavior can be by examining other implicit factors linked to the sexual behavior. From this understanding the social welfare committee and the administrative law motivate the compulsory institutional care by invoking overall evalution of the girls´ social problems and by redesigning the girls role as a victim to an agent.
