Custody cases regarding children with neuropsychiatricdisabilities (English)
Abstract [en]

The aim of this study is to examine how verdicts in the Swedish court system portrays thebest interest of the child in custody cases when the child has a neuropsychiatric disability.Previous research by leading experts in the field have indicated that there is anoverrepresentation of children with disabilities which led us to form the purpose and researchquestions for this essay. This was explored through analyzing four custody cases in both theCourt and Court of Appeals. In total, the material includes six children with aneuropsychiatric diagnosis. We have used a legal sociological perspective when analyzing thecourt cases to determine if the courts follow the norms presented in the law.The analyzed material showed that the assessment of the parent’s ability to take care of thechild does not clearly link to the child’s disability in the court’s argumentation. It also showsthat in cases where a child’s will is to be determined, the court chooses accounts from otherprofessionals rather than relying on the investigation performed by the social services.Furthermore, in all analyzed cases we found that there had been accounts of violence andabuse towards the children or the previous partner.
