    Abstract [en]

    In Sweden cruelty to animals can be penalized according to chapter 16, section 13 of the Penal Code (1962:700). Since the law demands the cause of the cruelty to be improperly, the crime often includes a weighting between the suffering of animals and the grounds of human behaviour that caused the suffering. The aim of this article is to study difficulties in the weighting between these factors. Methods of legal dogmatism, legal history and history of ideas are used. The article finds that suffering of animals and grounds of human behaviour often can be seen incommensurable factors, and that weighting between these factors therefore depends on the values of the person making the decision.

    Abstract [en]

    This article explores how adjudicators justify the rejection of an asylum application, by the practice of assessing credibility. This is done by analyzing written decisions from the migration courts in Sweden. By applying an intersectional theoretical approach which emphasizes the performative aspects of identities, it is argued that the court decisions constitute important sites for the formation, subversion and rejection of identities. The analysis reveals that the formal judicial criteria for assessing credibility are not the only tools that are used by the adjudicators. In addition, informal presumptions about how gender, education, culture and religion determine individual asylum applicants’ behavior play significant roles for the outcomes of the credibility assessments. The article suggests that the way in which these presumptions are articulated in the decisions indicates that they actively limit the possibilities for unique or deviant asylum narratives to get recognized as credible in the court procedure.

    Abstract [en]

    According to the Swedish Substance Abuse (Special Provisions) Act a person may be sentenced to compulsory care for a maximum of six months by an administrative court if she has a serious ongoing substance abuse and needs care which cannot be provided through voluntary measures. The person must also risk seriously harming her physical or mental health, destroying her life, or harming herself or a next of kin. The latter does not include an unborn child and the courts are only to assess whether the grounds for commitment are sufficient in terms of the woman’s needs and risk for harm. The legislation does, however, leave ample scope for so called fairness arguments (“reella hänsyn”). This article studies the extent to which the pregnancy is accentuated in court rulings and in what way – with a special focus on fairness arguments.
