    Denna författningssamling innehåller grundläggande Europeisk lagtext som används på kursen i Europarätt vid Juridiska Institutionen, Stockholms universitet, d.v.s. EU:s Unionsfördrag, Funktionsfördrag och Rättighetsstadga samt Europakonventionen. Författningssamlingen innehåller också de grundläggande statsrättsliga författningar som används i kursen i Statsrätt, d.v.s., våra fyra grundlagar, riksdagsordningen samt författningar som kompletterar eller ansluter till dessa författningar. Samlingen är primärt avsedd för kurser i europarätt och statsrätt på universitetsnivå, särskilt med avseende på Europarätt och Statsrätt vid Juridiska institutionen, Stockholms universitet, men kan givetvis också utgöra ett hjälpmedel för yrkesverksamma jurister och andra som kommer i kontakt med europarättsliga och statsrättsliga frågor

    Abstract [en]

    This article begins with an overview of the structure of local governance in Sweden. It then examines the division of competences between municipalities and county councils, and the population register that determines the applicable law. Following this, the article focuses on health care schemes and the possibility for the competent county council to determine substantive health care. The municipalities' responsibility for long term social care is then considered. Finally, the municipalities' room for manoeuvre in relation to the social assistance scheme is reviewed. The concluding section discusses Sweden's decentralised approach to social security.

    Abstract [sv]

    Europarätten har fått ett stort genomslag och intar numera en central roll i de nationella rättsordningarna. Detta tack vare medlemsstaternas och de nationella domstolarnas övervägande acceptans av europarätten trots att den griper in, påverkar, förändrar, tar över och i vissa fall till och med underkänner nationell rätt. Acceptansen är dock inte ovillkorlig utan europa rätten bygger på en levande dialog; ett kritiskt utbyte av tankar. Avsikten med boken Kritiskt tänkande inom europarätten är att den ska, tillsammans med en huvudbok i europarätt och väl anpassade seminarieövningar, reflektera över de underliggande rättsliga spänningsfälten och utmaningarna som EU ständigt står inför. Boken utgör på så vis ett steg på vägen för juridikstuderande till ett självständigt kritiskt förhållningssätt till europarätten.

    Abstract [en]

    The aim of the thesis Suveränitetserosion? is to examine how EU law relates to and has an impact on the national social security systems of the Member States with a special focus on the Swedish social security system.

    The thesis starting point is that there is a matter of conflicting interests; the Member States’ understanding of coordination is limited due to the idea of a state as sovereign with a nationwide sense of solidarity within an agreed economic framework while the point of departure for the EU concerning the coordination is based on the idea that the territorial systems of the Member States should open up to ensure a greater free movement of persons.

    With the advent of the European Economic Community in 1958, the social security systems of the Member States were coordinated through Regulation 3/58 in order to support the free movement of workers: a coordination which at the same time was supposed to respect the competences of the Member States as regards their respective social security systems. The legal landscape in 2015 looks markedly different compared to 1958. Today, the landscape is instead characterised by three Union legal structures independent of each other. Apart from the legal mechanisms of the Internal Market, today, Union citizenship as well as the Charter of Fundamental Rights must be taken into consideration. Initially, it is a matter of a legislation-governed development that has led to three parallel forces in action which cooperate, reinforce, defend but also change the view of coordination. Furthermore as new patterns of movement and unforeseen legal situations have developed, questions have arisen for which the current Regulation 883/2004 has had no answer but which still must be answered. It is at these crossroads that the Court of Justice of the European Union has had to choose between more or less Europe. This is where the questions about how and why the rulings of the Court of Justice of the European Union have had an impact on the national social security systems have come to the fore.

    The Swedish example clearly illustrates the challenges that national welfare models face when they are exposed to Union law. The Swedish model has, as the thesis concludes, been highly affected although no radical changes in benefits or a tendency towards more work-based benefits have as yet been introduced.

    The Member States’ social security systems are, as the thesis concludes, affected by the Internal Market and also by Union citizenship which gives an individual the right to move freely within the EU. In the future, the Charter of Fundamental Rights, which as yet has not shown its full potential, may gain in importance. The question that must be asked therefore is whether the EU shall be given the mandate to legislate the future development of social security or whether, as has been the case over the last fifty years, it should primarily be developed by the Court of Justice of the European Union.
