    Abstract [en]

    Bulgaria belongs to a group of Central and East European (CEE) countries, which until only recently were commonly referred to as ‘transition economies’. As is well known, for several decades after the end of World War II, Bulgaria was part of the Soviet sphere of influence and was characterised by command economy and authoritarian rule. Following the demise of state socialism, the country embarked on a difficult path of reforms towards building democracy, rule of law and a social market economy. Importantly, already in the early 1990s the country made clear its aspirations to join the European institutions. Indeed, in 1992 Bulgaria was accepted as member to the Council of Europe and in 2007, after lengthy negotiations and years of monitoring, technical assistance and preparation, acceded the European Union (EU). These processes of transition and integration in the European institutions have been decisive for determining the direction of Bulgarian consumer law and policy, as well as for shaping the modalities of consumer law enforcement. As a result of sustained efforts, the country now has in place detailed consumer legislation, closely following EU consumer law instruments, and a full-fledged institutional framework of consumer law enforcement with a variety of public and private bodies and enforcement avenues. This development has certainly contributed to improving the position of Bulgarian consumers. Nevertheless, the system of enforcement still suffers of serious weaknesses, related foremost to limited resources and institutional capacity, and to imperfect implementation and application of consumer law.

    Abstract [en]

    Sweden is widely regarded as a country with high profile in consumer protection policy and well functioning consumer law and institutions. The foundations of the legal and institutional framework of consumer policy were laid down already at the end of the 1960s and the beginning of the 1970s. This framework, with specialised consumer law statutes and prominent public institutions entrusted with the implementation and enforcement of consumer law and policy, has generally stood the test of time. Most of the original institutions, like the Swedish Consumer Agency (Konsumentverket, KOV) with the Consumer Ombudsman (Konsumentombudsmannen, KO) and the Public Board for Consumer Complaints (Allmänna reklamationsnämnden, ARN), are still in place. There is furthermore remarkable continuity in the overall structure and general principles of consumer legislation. Certainly, in the course of the almost six decades of active consumer policy, some important changes in the approach to enforcement and more generally, to the governance of consumer policy have taken place in response to various political and societal developments. A particularly significant factor for change has been Sweden’s accession to the European Union (EU) in 1995 and the ensuing process of Europeanisation.

    Abstract [en]

    The EU’s Role in Fighting Global Imbalances looks at the role of the European Union in addressing some of the greatest challenges of our time: poverty, protectionism, climate change, and human trafficking. Contributions from ten leading scholars in the fields of economics, law, and political science provide in-depth analyses of three key dimensions of EU foreign policy, namely: the internal challenges facing the EU, as its 28 member countries struggle to coordinate their actions; the external challenges facing the EU on the global arena, in areas where global imbalances are particularly pervasive, and where measures taken by the Union can have an important impact; and the EU´s performance on the global arena, in the eyes of other key actors. Based on a broad and interdisciplinary understanding of the concept of global imbalances, this book argues that these challenges follow from pervasive global imbalances, which at root are economic, political, and legal in character.

    Crime policy is increasingly legitimised by reference to the public sense of justice. A research project has therefore been conducted in all five Scandinavian countries in order to examine the public’s views on punishment. These views have been examined by means of simple questions in telephone interviews, by vignettes in postal questionnaires, and by focus groups having seen a film of a mock trial. The results show that when asked simple questions, the public want stiffer sentences. In their assessments of the vignette crimes, the public demands on average lower prison sentences than judges, and this tendency becomes stronger in the focus group study. The propensities towards punitiveness seem to diminish with more information and increasing proximity to the parties involved.

    This essay reviews three books as they document and explain the 1990s crime decline: Alfred Blumstein and Joel Wallman, eds., (2006) The Crime Drop in America; Arthur S. Goldberger and Richard Rosenfeld, eds., (2008) Understanding Crime Patterns: Workshop Report; and Franklin E. Zimring (2007), The Great American Crime Decline.

    It presents the empirical detail of the crime decline and examines the most commonly cited explanatory factors: imprisonment, policing, demography, and economic growth. It then suggests alternative lines of research in urban sociology—urban development, youth culture, and immigration—that may better explain the decline as the result of changes in the cultural and social fabric of American society, particularly in cities where the steepest declines occurred.

    This paper deals with girls and young women, who are involved in armed conflicts and organized armed violence, in Latin America. It is taken from both a Sociology of Law and a gender perspective. Although there are many children involved in wars today, it is important to account for those children who are also involved in organized armed violence. In doing so, we can then understand the true nature of the problem of how armed children and young people are affected socially, economically and politically in the region as a whole. The paper will present the cases of Colombia and El Salvador as examples.

    In Central and South America, since the 1960s, guerrilla groups, paramilitary groups and the armed forces, have all incorporated child soldiers into their ranks. Many groups have involved young girls as child soldiers, who come primarily from peasant and indigenous groups, either by incentive or by force. This has been especially the case in El Salvador, Guatemala, Honduras, Nicaragua, Colombia and Peru. With the ending of the civil wars in most of these countries and the subsequent transition to new democracies, a number of young girls and boys, who had been child soldiers, fell into the arms of juvenile gangs and organized armed violence (pandillas). To understand what are the root causes and the consequences of their actions and how and why they decide to get involved in organized armed violence and armed conflicts, it is important to look at the environment they were born in and grew up in. This involves examining the effects of the civil wars and the problems of acute poverty; unemployment and violence in the family, as well as, state corruption and an oppressive state apparatus.

    The study is based on the following sources, first, from the United Nations, UNICEF, UNIFEM, as well as the OAS and UNESCO and, second, from international and national NGOs, particularly Human Rights Watch, the Coalition to Stop the Use of Child Soldiers, Save the Children, Amnesty International as well as previous research on this area. The paper as well takes into consideration the role played by these national and international NGOs and the specific demobilization, re-integration and rehabilitation needs for boys and girls in those armed groups.

    From a distinctly theoretical perspective, the paper looks at the interrelation between gender, age, class and ethnicity. A gender perspective on childhood and child law is also included in the discussions on theory.

    El objetivo de este artículo es presentar algunas reflexiones desde la perspectiva de la sociología del derecho y de género, sobre la discusión actual entre género, ciudadanía y derechos humanos tanto desde un punto de vista teórico como práctico. Los ejemplos son tomados de América Latina en general y, de manera especial, de los acontecimientos ocurridos recientemente en Argentina.  El contexto del debate es resultado de la particular inserción del tema en el proceso de globalización y, consecuentemente, en las reestructuradas instituciones de un Estado Nación que ha cambiado incluso los conceptos básicos de soberanía, territorialidad, autoridad, producción de derechos y ciudadanía. Algunas de las preguntas de interés en esta investigación son las siguientes: ¿Cómo afecta el proceso de globalización a la función del Estado Nación y al concepto de ciudadanía desde una perspectiva de género en América Latina? ¿Cuál es la interrelación entre ciudadanía, género, clase y etnicidad? ¿Qué relación existe y ha existido entre el desarrollo de los derechos políticos, socioeconómicos y los derechos sexuales y reproductivos de las mujeres en el continente? El trabajo realiza un análisis cualitativo de las investigaciones desarrolladas por autores latinoamericanos, europeos y norteamericanos; también incorpora los estudios realizados por organismos internacionales (ONU), regionales (OEA) y organizaciones no gubernamentales (ONGs) de carácter nacional e internacional.

    Este artículo intenta debatir el tema de la violencia sexual contra las mujeres durante las últimas dictaduras militares en América Latina, especialmente en el caso argentino,  y algunas de sus  consecuencias en el ejercicio actual de sus derechos sexuales y reproductivos. Se intenta aquí analizar en qué medida el ejercicio de la sexualidad tiene una relación con el ejercicio del poder, el cual organiza, gestiona, distingue y jerarquiza conductas dependiendo de un proyecto político, social y cultural, en un tiempo y espacio determinado. Es decir lo público y lo privado, el poder y la sexualidad en relación al concepto de la patria, la clase, la raza y la religión, y con ello el control político de la reproducción y del modelo de familia,   incluyendo distintas expresiones de control social y violencia sexual de género.

    Al respecto, en su último informe de julio 2010, el Comité Internacional para la discriminación de la mujer (CEDAW), recomienda en el caso argentino: “…que se adopten medidas proactivas para hacer públicos, enjuiciar y castigar los incidentes de violencia sexual perpetrados durante la pasada dictadura, en el marco de los juicios por crímenes de lesa humanidad, de conformidad con lo dispuesto en la resolución 1820 (2008) del Consejo de Seguridad, y que se concedan reparaciones a las víctimas”.

    En el análisis se discuten algunas concepciones teóricas feministas, tales como el concepto de género y nación desde una perspectiva interseccional, desarrollado por Yuval Davis, la idea de postcolonialidad y descolonización del feminismo de Chandra T. Mohanty, y la relación entre género y globalización de Nancy Fraser.

    This article suggests a re-interpretation of human rights accountability taking into account the globalization process, the crisis of the modern nation-state and the new role-played by transnational, national and local actors in implementing and developing human rights law. The focus on impact and accountability is meant to demonstrate the importance of, and the legal basis for, broadening human rights advocacy in addressing additional actors. Non-state actors contribute to the production, interpretation and implementation of international human rights norms either directly or indirectly. They have also contributed toward underlining a core of basic values and common concerns on which to build a new normative people-centered framework. To counteract the limits and weakness of the Nation-State, it is imperative to strengthen the transnational advocacy of promotion and protection of human rights, which can create a “cosmopolitan consciousness of human rights" in the global world.
