    Abstract [en]

    This dissertation is written in the field of public law and examines the Swedish Office of the Parliamentary Ombudsman (OPO). The work examines the legal regime governing the OPO as well as the provisions directly relevant to the functions of that office. The OPO is governed by the Instrument of Government, the Riksdag Act and the Ombudsman's Instruction; these rules are examined in detail.

    The dissertation seeks to answer two questions. The first reads as follows:

    * Why has the OPO, despite changed constitutional and societal conditions, retained its raison d'être?

    In summary, the Ombudsman's complaint review procedure appears to be of great significance in that it upholds the legitimacy of the exercise of public power in the eyes of the citizenry. Through the work of the Ombudsman, citizens obtain an independent and highly expert legal review of the case, which can result in well-deserved satisfaction for the individual. It is however mainly within the context of the Ombudsman's critical and legal pronouncements that the OPO has its greatest significance today. The critical pronouncements have an important preventive effect and the legal pronouncements have earned a central position within certain legal fields. Many fundamental rules of procedure, of significance for the constitutional state and the individual's right to due process, would otherwise have remained vague and ambiguous.

    The dissertation's second question reads as follows:

    * Whether the OPO, considering its purpose, is subject to a satisfactory regime?

    The author answers this question in the negative. The Ombudsman's most important purpose is to exercise supervision of the public administration's conformity with the applicable legal rules and the dissertation presents a number of cases where the Ombudsman is able to cite flagrant violations of constitutional rights and fundamental due process guarantees without any forceful response, in the form of prosecution or a report for disciplinary measures, has been forthcoming. The cases have generally only resulted in critical pronouncements. There are strong indications that the Ombudsman lacks sufficient powers to impose sanctions. The dissertation presents a proposal to equip the Ombudsman with the power to grant damages when a public body has violated its duties. The main argument in favour of this solution is that this would be an effective means of strengthening the Ombudsman's possibilities to forcefully condemn improprieties committed by public bodies. Such a reform would also increase the OPO's credibility in the eyes of complainants and, ultimately, the public at large.

    The question at hand throughout this thesis is how the Swedish system for taxation of pension insurances – in both individual and occupational private pension schemes – interacts with other tax systems in an international context. This question includes several aspects. What are the outcomes when the Swedish system interacts with another Member State’s tax system in a cross-border situation? To what degree does the Swedish taxation of pension insurances live up to the underlying objectives of the system? Does the Swedish system constitute a restriction to free movement in the internal market for pension insurances? In order to be able to answer these and similar questions, a number of concrete situations that arise when the Swedish tax system meets a differently designed tax system of another Member State – Finland – are analysed. The Swedish taxation of pension insurances differs from that of a number of Member States as the Swedish system not only subjects the pension capital to a yield tax but also taxes the benefits upon disbursement to the beneficiary. In most other western European Member States – among them Finland – only the disbursed benefits are subjected to tax.

    The results of the situation into the tax consequences in cross-border situations show that the Swedish system for taxation of pension insurances is not functioning in an international context. Sweden only manages to maintain the reciprocity within its tax system in a few of the analysed situations. The taxpayers are subjected to double taxation – sometimes even triple taxation – which is not eliminated by double taxation agreements or by regulations on credit-of-tax in national law. In the internal market for pension insurances, free movement is restricted and from a strictly national perspective, the underlying objectives of the Swedish system are not achieved.

    Verksamheten i försäkringsbolag har länge ansetts vara av särskild be­tydelse för både enskilda och samhälle. Samtidigt är verksamheten komplex till sin natur och förenad med speciella risker. Försäk­ringskunder agerar ofta på grundval av brist­fälliga kun­skaper rörande dels egen­skaperna hos olika försäkringsprodukter, dels beskaffenheten av riskerna hos försäk­ringsgivarnas till­gångar och skul­der. Mot bak­grund av dessa förhållanden uppställer försäkringsrörelselagen (1982:713) stränga krav rörande såväl med­delande av till­stånd (koncession) för bedri­vande av för­säk­rings­rörelse som för hur verk­samhe­ten skall bedri­vas.

     

    Den avgränsning som görs i för­säkrings­rörelselagen beträffande dess tillämp­nings­om­råde sker genom att det i lagen anges att försäkringsrörelse endast får drivas med koncession av försäkringsaktiebolag och ömsesidiga försäkringsbolag. Vad som avses med försäk­rings­rörelse anges emeller­tid inte. Det har medfört att gräns­drag­ningen mellan till­stånds­pliktig för­säkrings­rörelse och annan, likartad verksamhet är oklar. Att så är fallet innebär bland annat att tillämpningen, exem­pelvis vad gäller tillsyn, av de bestämmelser som reglerar verk­samheten i försäk­rings­bolag riske­rar att för­svåras och fördyras.

     

    I boken undersöks och preciseras gränserna för till­ståndspliktig försäkrings­rörelse från en principiell utgångspunkt. Särskild uppmärksamhet ägnas frågan vilka grundläggande kriterier som utmärker sådan verksam­het.

    The ‘Regional and National Context’ under the ASEAN Human Rights Declaration and its Implications for Minority Rights2017Rapport (Annet vitenskapelig)
    Abstract [en]

    The notion that human rights are universal, i.e., to be applied in the same way everywhere regardless of regional or national particularities, has in recent decades been called into question by governments in various regions of the world. These governments argue that the nature and scope of international human rights obligations may be determined in the context of each region’s and nation’s unique “culture”, broadly defined as history, religion, need for economic development, etc. Such cultural relativism is known in East Asia under the rubric of ‘Asian Values’ and is embraced in the 2012 ASEAN Human Rights Declaration (AHRD) through that instrument’s reference to the need to consider the “regional and national context”. The ten member nations of ASEAN span a population of over 600 million and form a rich mosaic of national and minority cultures. Examples of current rights issues faced by the region’s myriad minority populations are resettlement of indigenous groups in Laos for the building of infrastructure projects; the protection of language rights among Thailand’s Khmer-speaking minority; and human security issues in Burma’s ethnic states. Minority cultures thus seems an apt topic for inquiry under the AHRD and, in that connection, the present article will address what the AHRD’s embrace of the “regional and national context” likely implies for the protection of minority rights. For purposes of this article, minority rights will refer to the rights of ethnic, religious or linguistic minorities “to enjoy their own culture, to profess and practice their own religion, or to use their own language” within the meaning of Article 27 of the International Covenant on Civil and Political Rights (ICCPR).

    Law, Liberation, and Human Rights: Emerson and the Radical Yankee Debt to English Lawyers2006Konferansepaper (Fagfellevurdert)

    After the Civil War, in 1866, Ralph Waldo Emerson received the honorary degree of Doctor of Laws from Harvard. Nearly thirty years after his address on the American Scholar, he appeared for the second time as the orator at Phi Beta Kappa, once again preaching his liberal ideals, praising and presenting the correspondence between the material and the spiritual, and the common centrality of the physical and the ethical worlds. But Emerson's philosophy of law had become intermingled with a jurisprudential idea of natural law and natural rights in his later conception of the “higher law”. Emerson could never forgive the diplomatic Unionist Daniel Webster, for having helped to pass the Fugitive Slave Law. The main fault with Senator Webster was, according to both Emerson and Theodore Parker, that he lacked faith in the “higher law”. Webster refuted that notion, which was reckoned as a good joke at some courts. In his argument against the Fugitive Slave Law in 1851, Emerson referred to the Higher Law and to the Bible, when he stated that immoral laws are void. His approach was explicitly juridical, however. The “great jurists, Cicero, Grotius, Coke, Blackstone, Burlamaqui, Vattel, Burke, Mackintosh, Jefferson, do all affirm this”, namely, that no human laws are of any validity, if they violate the law of Nature, among whose principles are, according to Blackstone, “that we should live on, should hurt nobody, and should render unto every one his due”. We are “bound to transgress” such a human law; or else we must offend “both the natural and the divine.” It is not only contrary to “the laws of God”. Natural laws of the human mind, and of human existence — laws of our existential and social nature — are violated.

    Hugo Grotius, and after him Samuel Pufendorf, developed a theory of international legislation based upon “natural law”. The rules of the human reason are, according to Grotius and Pufendorf, as immutable as the laws of the universe: they are but expressions of the same force. Their ideas paved the way for clearing the law concept from theology in an age when higher mathematics was developed and cosmic laws were discovered by Kepler and Newton. Not even to God it is granted to upset infinitesimal calculus. The new idea of “natural rights”, but also Deism and Determinism, would accordingly follow. Grotius, however, did not think that an equal certainty can be found in ethics and in mathematics. His successor Pufendorf did, and John Locke, the foremost spokesman of natural rights, preferred the latter. Emerson does not refer to Pufendorf or to Locke in his argument. But he does refer to Grotius. He is cited in the early lectures, even in the sermons. He hardly ever read him, however.

    From the good authority of his extant notebooks, Emerson's most important sources can be determined with certainty. From excerpts written late in 1850, we can see that he drew heavily for his statement from William Blackstone's influential Commentaries on the Laws of England (1765). Emerson used a New York edition, printed in 1843. He also used John Lord Campbell's recent The Lives of the Chief Justices of England (1849). Emerson's quotations from Blackstone in the Fugitive Slave Law Address, are from the Commentaries. In both works Emerson met with the standpoint taken by Edward Coke (1552-1634), who attracted Emerson as much as the views of Blackstone did. Of special importance to Emerson, was the event of November 10, 1608, when the judges and the Exchequer Barons in England accused — and tried — James I at Hampton Court. Emerson copies the King's words from Baron Campbell: “King James said to Coke C[hief] J[ustice:] ‘My lord, I always thought, & by my soul I have often heard the boast that your English law was founded upon reason. If that be so, why have not I & others reason, as well as judges?’” The King maintained his sovereignty. Why should he be under the law? Coke answered that God and Law are sovereign, that the law does command the King. Emerson knew Coke's reply to His Majesty, in Archbishop Bracton's words, by heart. It is still visible in the golden motto above the portal at Harvard Law School, marking the ideological abode of the doctor of laws. Coke replied: Quod Rex non debet esse sub homine, sed sub Deo et lege. Indeed, the divine right of kings died when Charles I was beheaded in 1649. The English jurists also inspired the revolt of the colonies against British rule, the reign of George III. In America, Law became King.

    The purpose of this work is to detect a pattern: the concordance of Ethics and Aesthetics, Poetics and Politics in the most influential American thinker of the nineteenth century. It is an attempt to trace a basic concept of the Emersonian transcendentalist doctrine, its development, its philosophical meaning and practical implications. Emerson’s thought is analyzed genetically in search of the generating paradigm, or the set of axioms from which his aesthetic ideas as well as his political reasoning are derived. Such a basic structure, or point of convergence, is sought in the emergence of Emerson’s idea of universal laws that repeat themselves on all levels of reality.

    A general introduction is given in Part One, where the crisis in Emerson’s life is seen as representing and foreshadowing the deeper existential crisis of modern man.

    In Part 2 we follow the increasingly skeptical theologian’s turn to science, where he tries to secure a safe secular foundation for ethical good and right and to solve the problem of evil.

    Part 3 shows how Emerson’s conception of the laws of nature and ethics is applied in his political philosophy.

    In Part 4, Emerson’s ideas of the arts are seen as corresponding to his views of nature, morality, and individuality.

    Finally, in Part 5, the ancient and classical nature of Concord philosophy is brought into focus.

    The book concludes with a short summary.

    This study deals with the protectability of stage direction by copyright. According to the preparatory works relating to the Swedish Copyright Act, stage directors will normally fall within the category of interpreters of works, performing artists, rather than creators of works, authors. However, under special circumstances the director can be regarded as an author. The purpose of this study is to clarify the difference between the two categories of copyright protection and to examine the status of the stage director within that perspective.

    The study, in addition to Swedish and Scandinavian law, also looks at the French, German and US approaches to protection for stage directors. With respect to France and Germany, particular attention has been paid to the distinction between author and performing artist which is manifested in the context of assessing the status of the stage director. In the US no such distinction is made for the purpose of determining the stage director's protection.

    The comparison between authors and performing artists has shown that among the differences which are often advanced, there is only one of major importance: whereas the author and his work are separable, the opposite applies to the performing artist and his achievement.

    The director in this regard is similar to the author rather than the performing artist. The product of his effort - the stage direction - can exist independently of the director. It follows that the stage director needs protection which is essentially the same as that enjoyed by the author.

    In 2015, the European Union (EU) was facing the largest migration crisis in modern history. In light of the high reception of asylum seekers in Sweden during the autumn of the same year, a temporary law (2016:752) was adopted which restricted the possibilities of obtaining a permanentresidence permit and of family reunification. The law has received criticism for being contrary to Swedish convention commitments, especially the right to respect for family life and the prohibition of discrimination according to Articles 8 and 14 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (the Convention). Against the backdrop of this criticism, this thesis aims to examine whether the so-called Bosphorus presumption, also known as the presumption of equivalent protection, could be applicable in a hypothetic case where Sweden is brought before the European Court of Human Rights (the Court) for violating the Convention as a result of the temporary law. The criteria for the application of the presumption are firstly that the intrusive measure, here the restriction of the right to family reunification, can be said to fall within the scope of the strict international legal obligations of the state, meaning that the state can be said to have exercised a certain amount of discretion and to have enjoyed a certain margin of manoeuvre. The conclusion of this thesis is that likely would be considered to have exercised discretion as well as enjoyed a margin of manoeuvre when restricting the right to family reunification by adopting the temporary law. This conclusion is mainly based on the fact that the international legal obligations in this case flow from directives, which are binding on member states only as to the result to be achieved, and leave the choice of form and methods to the authorities of the member state. Furthermore, the directives which the temporary law is based on are so-called minimum directives, which allow for the member states to provide a higher level of protection.
