    This thesis examines open distributed blockchain technology from a legal perspective. The blockchain is a technology used to secure and ensure the integrity of data in an unsafe digital environment. Traditionally, peer-to-peer networks (P2P-networks), synonymous with distributed networks, have faced the issue of ensuring the integrity of data and deterring scams such as double spending, which refers to someone using the same assets twice, and has discouraged people from using P2P-networks. Scams like double spending have been possible in the absence of a governing party ensuring the integrity of the data, that is until the introduction of Bitcoin in 2008, which introduced a cryptographic solution to ensuring the data’s integrity in a P2P electronic cash system. By relying on cryptography, instead of trusting institutions for the integrity of transactions, the introduction of Bitcoin facilitated a move towards decentralization where classical middleman services, like banking, are becoming obsolete.The General Data Protection Regulation (GDPR), which is to be implemented in all European Union (EU) member countries on May 25th, 2018, is a regulation that aims to harmonize data privacy laws across Europe. The GDPR introduces several fundamental rights and freedoms for natural persons regarding the protection of their personal data. This means that certain responsibilities are imposed on the responsible parties that process personal data.This thesis examines to which extent the GDPR is applicable to an open distributed blockchain and if the fundamental principles under the regulation can be upheld, respectively if the responsible parties can fulfill their responsibilities imposed by the regulation.

    Due to its extraterritorial effect, the European Union's trailblazing data privacy law has long been a major concern for US. businesses. With the proposal for a new EU data privacy framework with potential penalties of up to two percent of an offending enterprise's annual worldwide turnover, and with the European Union at the same time expanding the extraterritorial reach of its data privacy law, such concerns are justified indeed. This Article examines the extraterritoriality of current and proposed EU data privacy law and analyses whether reference to international law can either strengthen or weaken those claims of extraterritoriality. In doing so, this Article demonstrates that international law lends support to the approach to extraterritoriality adopted in the EU data privacy law. At the same time, however, the examination of EU law highlights that, from the perspective of extraterritoriality, the current EU Directive is dysfunctional in its unnecessary complexity, and the proposed EU Regulation is in desperate need of refinement. Finally, the Article presents a doctrine of market sovereignly, established by reference to the effective reach of market destroying measures, as a mechanism for determining the extraterritorial reach of jurisdictional claims.

Drivfjädern kan vara att påvisa skillnader eller likheter visavi tidigare lösningar. Diskussionerna är många och resultaten ofta detaljerade. Ett exempel är åtskiljandet av olika former av uppsåt.

    Juridiska klassificeringar är dock inte alltid optimalt utformade. En del är outvecklat eller svårbegripligt. Andra indelningar verkar ha överlevt sig själva.

    Kraven på lagarna skärps alltmer. En snabbare förändringstakt på i stort sett alla regleringsområden är en förklaring. Globaliseringen, samhällets ökande komplexitet och en intensifierad mediabevakning är några andra orsaker. Till detta kommer att alltfler problem som traditionellt har hanterats med hjälp av lagstiftning kan lösas på andra sätt. Många gånger träder tekniska system i förgrunden. Att freda datorer mot virusangrepp, att bevaka upphovsrätt eller att hantera skattelagstiftningen enbart med hjälp av skriven lag är inte möjligt. Lagarna kompletteras respektive ersätts av andra, ofta proaktivt verkande mekanismer.

    Metoderna för att stifta lag är samtidigt outvecklade. Utbildningen i lagstiftningsteknik är obefintlig. Rekryteringen till lagberedningar sker enligt rutiner etablerade då helt andra förutsättningar gällde. Sätten att organisera utredningarna tar ringa hänsyn till utvecklingen av analytiska metoder. Preciserade anvisningar saknas. Effekterna av ny lagstiftning följs sällan upp.

    Lagstiftning är mot den bakgrunden ett arbete om lagarnas framtid. Grundtesen är att samhällets omvandling i högre grad måste återspeglas i lagarnas utformning. Risken är annars att lagstiftningen på alltfler områden förlorar sin praktiska verkan.

    Framställningen utgår från rådande uppfattningar om lagarnas rationalitet. Därtill beskrivs några generella lagstiftningsproblem. I centrala avsnitt inventeras utvecklingslinjer, framför allt med hänsyn tagen till tekniska framsteg och möjlig metodutveckling. Studien avslutas med en diskussion om konsekvenserna av olika vägval.

    Boken vänder sig till lagstiftare, jurister och alla som har att förlita sig på lagstiftningen för att nå eftersträvade resultat.

    On 25 May 2018 the General Data Protection Regulation, GDPR, came into force in the EU.

    The regulation strengthened the rights of the data subjects’ in relation to the data controllers

    and processors and gave them more control over their personal data. The recitals of the GDPR

    state that it was the rapid development in technology and globalisation that brought new

    challenges for the protection of personal data. Private companies and public authorities where

    making use of personal data on an unprecedented scale in order to pursue their own activities.

    The protection should be technologically neutral and not dependant on the technique used.

    This leads to questions on whether the protection that is offered through the GDPR is de facto

    applicable on all technologies. One particular technology which has caught interest of both

    private companies and public authorities is the blockchain. The public distributed blockchain

    is completely decentralized, meaning it is the users who decide the rules and its content. There

    are no intermediaries in power and the transactions of value or other information is sent peer

    to peer. By using asymmetric cryptography and advanced hash algorithms the transactions

    sent in the blockchain are secured. Whilst the interest and use of blockchain is increasing and

    the GDPR attempting to be applicable on all techniques, the characteristics of the public

    blockchain must be analysed under the terms of the GDPR. The thesis examines whether

    natural persons can be identified in a public blockchain, who is considered data controller and

    data processor of a public blockchain and whether the principles of the GDPR can be applied

    in such a decentralised and publicly distributed technology.

I artikeln argumenteras emellertid för att vanlig hypertextlänkning till öppet tillgängliga datafiler, i vilka upphovsrättsligt skyddade verk gjorts tillgängliga på internet med upphovsmannens samtycke, inte faller under den EU-harmoniserade ensamrätten att överföra verket till allmänheten.

    Den offentliga sektorn utvecklar och låter utveckla stora mängder datorprogram (specialutvecklade program). Betydande delar av dessa program skulle, mot bakgrund av att förvaltningen många gånger har likartade behov, kunna användas i andra verksamheter än för vilka de ursprungligen skapats. En sådan återanvändning av datorprogram skulle kunna leda till effektivitetsvinster, men har även potential att höja kvaliteten på förvaltningens IT-tjänster och att bidra till en mer enhetlig IT-infrastruktur och mer enhetliga elektroniska tjänster för medborgarna.

    Syftet med denna promemoria är att översiktligt redovisa de juridiska förutsättningarna för återanvändning av datorprogram och programkod som utvecklats av eller för den offentliga sektorn (stat eller kommuner). Det handlar dels om att identifiera

    eventuella rättsliga hinder mot en ökad återanvändning, dels om att föreslå vilka rättsliga åtgärder som kan vidtas för att i praktiken underlätta en ökad återanvändning. Huruvida återanvändning av datorprogram, generellt eller i det enskilda fallet, av praktiska eller ekonomiska skäl bör eftersträvas eller ej diskuteras inte.
