Abstract [sv]

Abstract [en]

This anthology presents a rich and comparative exploration of the constitutional foundations of welfare states in Sweden and South Korea, two societies that have pursued social protection and economic equality through markedly different historical trajectories. Bringing together a multidisciplinary group of scholars, the volume examines how welfare rights are conceptualized, developed, and implemented within distinct constitutional and legal frameworks, offering new insights into the evolving relationship between law, politics, and social policy.

At its core, the book investigates a central question: what role does the constitution play in shaping welfare politics? Does it function as a driving force that actively structures social rights and public policy, or as a reflective framework that mirrors broader political and societal developments? Through theoretical analysis and detailed sectoral studies, the contributors engage with this question across key areas such as labor law, social insurance, and education, highlighting how constitutional principles are translated into concrete welfare mechanisms.

The volume situates these inquiries within broader traditions of constitutionalism, including the tension between political and legal constitutionalism, and explores how these models influence the protection and realization of welfare rights. It further demonstrates how legal culture, political ideology, and institutional design interact in shaping welfare outcomes. The Swedish case illustrates a historically strong welfare state developed with limited constitutional entrenchment of social rights, while the South Korean case reveals a more recent and constitutionally mediated welfare evolution shaped by democratization and rapid socio-economic change. By juxtaposing these two contrasting yet interconnected contexts, the anthology sheds light on the diverse pathways through which welfare states emerge and adapt. It emphasizes that constitutional frameworks are not merely legal structures but dynamic arenas in which social values, political struggles, and economic realities converge.

Timely and thought-provoking, this book speaks to scholars, policymakers, and students interested in constitutional law, social rights, and comparative welfare state development, offering a nuanced understanding of how law both constrains and enables the pursuit of social justice in contemporary societies.

Abstract [en]

According to the principle of conferred powers, a core principle of European Union (EU) constitutional law, the EU may only regulate in areas where the Member States have conferred it competencies to do so. While the EU has used its legislative power in wider areas over time, two traditional fields that for a long time have remained mainly within the national legislative area are tort law and general administrative law. For the last decade, there has been an increasing interest from the EU legislator side to make use of these national tools to ensure a uniform and effective implementation of EU law. Through thematic legislation on sector-specific matters, EU law today impacts legal areas further from the core of EU law—such as tort law and general administrative law. The reason for the EU legislator’s interest in these areas can be explained by the function, within these areas, of realizing EU legislation. In relation to the regulatory framework for the EU digital economy, the EU legislator has explicitly underlined the importance of developing trustworthy governance schemes for EU citizens to overcome their hesitancy to use digital tools and share their data. This development can be contrasted with the development within United States administrative law, which seems to be guided by distrust and limitations of the powers of the administrative organs.  This Paper will examine EU mechanisms for implementation through tort and general administrative law actions in the areas of data protection, artificial intelligence (AI), and PFAS chemicals, with a special focus on the Swedish legal setting.

Abstract [en]

The fragmented and divergent administrative governance systems for health data in the member states have been identified as an obstacle in the creation of the European Health Data Space (EHDS). One of the aims of the EHDS is therefore to create a legal framework of trusted governance mechanisms within the EU and the member states. In order to ensure access to electronic health data for the benefit of the society, the EHDS regulation introduces advanced administrative governance structures to be applied at the national level. The societal interest of access to health data must however be balanced against the rights and interests of the individual concerned. This chapter analyses the efficiency of the governance structures from the perspective of protecting rights and interest of the individuals concerned via two sets of administrative tools for balancing the competing interests. The first set of tools are legal, technical and organisational safeguards to protect the right to informational privacy. The second set consists of general administrative guarantees for protecting individual interests in the handling of their matters before a public administration, the right to good administration.
