Abstract [en]

Triggered by the war in Ukraine, Finland and Sweden applied for NATO membership and Finland has already joined. Neither country has changed their legislation on defence and security procurement due to the invasion. Sweden significantly increased the threshold for cases when art.346(1)(b) TFEU can be used by the procurement authority FMV or the armed forces themselves. Finland, a country with a long land border with Russia had a court case were reference to Russia launching a military invasion of Ukraine was accepted as one of the grounds for a direct award and a further pending case on the exemption from the relevant law based on art.346 TFEU.

Note

Upphandlande myndigheter har sedan en tid kunnat tecknat försäkringar för att täcka en eventuell utdömd upphandlingsskadeavgift – vilket i princip innebär ”carte blanche” för att bryta mot upphandlingslagstiftningen, utan allvarligare konsekvenser. Finansinspektionen, som ansvarar för regelutveckling på försäkringsområdet, har i ett rättsligt ställningstagande uttryckt att det strider mot god standard att tillhandahålla sådana försäkringar. Andrea Sundstrand redogör för beslutet och dess effekter.
